Restriction of Hazardous Substances and Waste Electrical and Electronic Equipment Reporting

Ensure compliance in CA, IL, IN, MN, NJ, NY, RI, and WI

Vanguard provides expert guidance and turnkey compliance solutions for electronics manufacturers and distributors impacted by RoHS and WEEE regulations across eight U.S. states — with more expected to follow.

What Is RoHS Compliance?

RoHS stands for the “Restriction of Hazardous Substances” in electrical and electronic equipment (EEE). Initially implemented in the European Union, similar requirements are now in effect in several U.S. states. These laws prohibit the use of six specific hazardous materials in EEE products:

  • Lead (Pb)
  • Cadmium (Cd)
  • Mercury (Hg)
  • Hexavalent chromium (Cr VI)
  • Polybrominated biphenyls (PBB)
  • Polybrominated diphenyl ethers (PBDE)

RoHS-compliant products are safer for both human health and the environment. Vanguard helps your organization navigate complex product material reviews, supply chain declarations, and reporting protocols.

What Products Are Affected?

RoHS applies to a broad range of consumer and industrial electronics, including:

  • Stores or uses any of the 258 regulated substances identified by the EPA.
  • Exceeds threshold quantities (TQs) (e.g., 10,000 pounds of anhydrous ammonia, 20,000 pounds of propane).
  • Substances must be connected to a process.
  • Falls under one of the three RMP Program Levels, based on process complexity and public risk.

Industries frequently impacted include:

  • Chemical manufacturing
  • Agricultural facilities (fertilizer storage)
  • Cold storage and food processing
  • Petroleum refining
  • Water and wastewater treatment plants
  • Industry and Manufacturing (if substances are present in excess of TQs)

  • Printed circuit boards

If your product is sold in California, Illinois, Indiana, Minnesota, New Jersey, New York, Rhode Island, or Wisconsin, compliance is mandatory.

What Is WEEE?

WEEE stands for “Waste of Electrical and Electronic Equipment.” It focuses on the responsible recycling, recovery, and disposal of EEE products. Some U.S. states now require manufacturers and retailers to register, report product weights sold into the market, and contribute to collection and recovery efforts.

Vanguard manages both initial and ongoing reporting, ensures product labeling, and tracks end-of-life obligations.
